4.2 L’utente è tenuto a verificare immediatamente i prodotti consegnati e denunciare eventuali difetti o difformità entro dieci (10) giorni, per iscritto, contattando l’online shop. Trascorso tale termine, potranno essere denunciati solo i vizi occulti. 5. Proper use in this sense means storage, installation, commissioning, operation and maintenance in accordance with the product specifications or recognised industry practice. 7.3 Schulthess’s liability shall not extend to (a) traces of use or wear of second-hand appliances existing at the time the contract was concluded or (b) failure of new products as a result of wear, misuse or improper use, neglect of maintenance obligations or as a result of repairs or modifications not carried out by Schulthess. 7.4 Your warranty rights are governed by the Swiss Code of Obligations and include repair, replacement or return. A possible exchange is limited to new products and does not apply to second-hand appliances. 7.5 The warranty in this paragraph 7 supersedes and excludes all oral, written, statutory, express or implied warranties and conditions to the fullest extent permitted by law. 8. Limitation of liability 8.1 Schulthess shall be liable without limitation for damages caused intentionally or by gross negligence. In the event of a slightly negligent breach of a material contractual obligation or ancillary obligation which prevents the purpose of the contract from being achieved and which you could rely on being complied with (material ancillary obligation), Schulthess’s liability shall be limited to the extent permitted by law to foreseeable damage typical of the contract at the time of conclusion of the contract. In the event of a slightly negligent breach of ancillary obligations which are not material ancillary obligations, Schulthess’s liability shall be excluded. 8.2 Schulthess’s liability for damage resulting from injury to life, limb and health, in the event of fraudulent concealment of defects, in the event of assumption of quality guarantees and liability under the Swiss Product Liability Act (if applicable) shall remain unaffected. 8.3 The statutory rules on the burden of proof shall remain unaffected. 9.
